Identifying the Defendant

Identify the Defendant through business notepaper or letter head. Otherwise conduct companies office search to ascertain if the Defendant is a Limited company and obtain its registered address. Alternatively do a business names register search to discover the owner of the trade name. It may of course be a private individual or a partnership and not a limited company. Sometimes it may be a limited company using a trade name different to the company name.

Having completed the Claim Form A for the P.I.A.B. ensure that you get your Section 50 receipt. The Statute Limitations obliges you to formally commence your claim within 2 years of date of accident. If you begin your claim against an incorrect Defendant you could have a serious difficulty as your claim may become Statue barred.
